2. Eligibility and Authorized Use

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or enroll in our general business and professional services unless a particular Fresh Start program expressly permits participation by minors.

Youth, nonprofit, community, or educational programs involving minors may be governed by separate registration, parental consent, participation, or program requirements.

4. Purchases and Payments

Prices for Fresh Start products and services will generally be provided on the applicable website, checkout page, proposal, invoice, enrollment agreement, engagement letter, or service agreement.

You agree to provide accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Payments may be processed by third-party payment processors, and use of those services may also be subject to the provider's terms and privacy practices.

Fresh Start reserves the right to correct pricing errors, refuse or cancel fraudulent or unauthorized transactions, and discontinue or modify offerings as permitted by law.

5. Payment Plans and Recurring Payments

Certain programs, memberships, software services, retainers, subscriptions, or other offerings may provide recurring billing or installment-payment options.

When you select a recurring or installment payment arrangement, the specific price, billing schedule, duration, cancellation rules, and other material terms will be presented through the applicable checkout process, agreement, invoice, or enrollment terms.

By choosing a recurring-payment option and providing a payment method, you authorize the applicable charges described at the time of enrollment or purchase.

Canceling a recurring service does not automatically cancel amounts that were previously earned, incurred, contractually committed, or already due.

Any service-specific cancellation rights will be governed by the agreement or policy applicable to that particular product or service.

6. Refunds, Cancellations, and Credits

Refund and cancellation policies may vary depending on the type of Fresh Start product, service, program, event, software offering, digital product, or professional engagement purchased.

The refund or cancellation terms presented on the applicable checkout page, order form, engagement letter, service agreement, enrollment agreement, or specific Refund Policy will govern that purchase.

Certain products or services may be nonrefundable once delivered, accessed, downloaded, activated, started, performed, or otherwise made available, when permitted by applicable law and disclosed as part of the applicable purchase terms.

Nothing in these Terms eliminates cancellation or refund rights that cannot legally be waived.

7. Educational Information and Professional Advice

Unless you have separately engaged a Fresh Start company or professional to provide a specific professional service, general information available through our website, courses, social media, webinars, downloads, programs, or educational materials is provided for educational and informational purposes.

General educational information should not automatically be considered individualized:

8. No Guarantee of Results

However, we cannot guarantee a particular business, financial, tax, credit, funding, employment, revenue, income, software, marketing, or other outcome unless such guarantee is expressly provided in a separate written agreement signed by Fresh Start.

Testimonials, examples, case studies, revenue figures, business examples, student experiences, or client results are not guarantees that another person will achieve identical or similar results.

Your results may depend on many factors outside Fresh Start's control, including your actions, participation, experience, financial circumstances, market conditions, business decisions, compliance, timing, and other individual circumstances.

9. Tax and Financial Services

Tax preparation, tax resolution, representation, accounting-related, financial, lending-related, or similar professional services may require additional documentation and separate engagement terms.

Clients are responsible for providing complete, accurate, and timely information necessary for Fresh Start to perform an applicable service.

Fresh Start may rely on information and documentation provided by the client unless our specific professional obligations require otherwise.

Fresh Start does not guarantee:

A particular tax refund

Acceptance of a tax position by a taxing authority

Removal of penalties or interest

Approval of an offer, payment plan, or other tax resolution

Approval for financing or credit

Any particular financial outcome

Professional tax or financial engagements may also be subject to federal and state laws, regulations, professional requirements, agency procedures, and separate client agreements.

10. Software and Technology Services

Fresh Start may provide, license, resell, facilitate, integrate, support, or provide access to software and technology products.

Some technology products may be owned or operated by third-party providers.

Availability, functionality, integrations, updates, compatibility, data storage, outages, and other technical features of third-party software may be controlled by the applicable provider rather than Fresh Start.

Where applicable, users must also comply with the terms, licensing rules, acceptable-use requirements, and policies of the applicable software provider.

Unless expressly stated otherwise in a written agreement, access to software does not transfer ownership of the software, underlying code, intellectual property, platform, or technology to the user.

11. Courses, Training, Coaching, and Programs

Fresh Start courses, academies, workshops, coaching programs, certifications, training programs, communities, memberships, and educational resources are intended to provide education, training, tools, and support.

Enrollment does not guarantee:

Professional certification unless expressly stated

Government licensing or registration

Employment

Business revenue

Client acquisition

Tax-office approval

EFIN approval

Financing

Business success

Any specific financial result

When continuing education, certification, accreditation, professional credit, or another credential is advertised, eligibility requirements and program-specific rules may apply.

Participants are responsible for meeting applicable attendance, participation, testing, submission, licensing, regulatory, or professional requirements.

12. Intellectual Property

Unless otherwise stated, Fresh Start owns or has permission to use the content and intellectual property appearing on its websites and within its proprietary products and programs.

This may include:

Training materials

Videos

Workbooks

Templates

Documents

Checklists

Graphics

Logos

Branding

Website content

Written materials

Presentations

Software-related materials

Processes

Program names

Trademarks and service marks

Your purchase or enrollment gives you only the rights expressly stated for the applicable product or service.

Unless we provide written permission, you may not reproduce, distribute, resell, sublicense, publish, share, teach from, commercially exploit, or create unauthorized derivative products from Fresh Start proprietary materials.

You may not remove copyright, trademark, proprietary, or attribution notices from Fresh Start materials.

13. Digital Products and Downloadable Materials

Digital products, templates, guides, courses, recordings, downloads, and other electronic materials are licensed for the use described at the time of purchase.

Purchase of a digital product does not transfer ownership of Fresh Start's intellectual property.

Unless expressly authorized, customers may not upload purchased materials to shared drives, membership libraries, course platforms, artificial intelligence training repositories, resale platforms, or other locations for access or use by unauthorized third parties.

14. User Content, Feedback, and Submissions

If you provide reviews, testimonials, comments, suggestions, feedback, or similar voluntary communications, you represent that you have the right to provide that material.

We may use general feedback and suggestions to improve our business and services.

Fresh Start will not treat confidential client records, tax information, financial records, private account information, or other protected personal information as unrestricted public feedback merely because that information has been submitted to us.

We will obtain appropriate permission before intentionally publishing an identifiable customer testimonial, image, video, or similar promotional endorsement when permission is required.

15. Acceptable Use

You may not use our website, services, systems, communities, portals, software access, or content to:

Commit or encourage unlawful activity

Engage in fraud or misrepresentation

Infringe intellectual property rights

A link, integration, referral, or mention does not mean that Fresh Start owns or controls the third party.

Your use of a third-party service may be governed by that company's own contracts, policies, pricing, eligibility rules, underwriting standards, privacy practices, and terms.

Fresh Start is not responsible for a third party's independent acts, omissions, systems, services, products, content, security, availability, or decisions.

17. Affiliate and Referral Relationships

Fresh Start may occasionally recommend products, services, software, or providers through referral or affiliate relationships.

When required, we will disclose applicable affiliate or compensated relationships.

A referral or affiliate relationship does not guarantee the quality, availability, performance, approval, pricing, or suitability of a third-party product or service.

You remain responsible for determining whether a third-party product or service is appropriate for you.

18. Website Information

We make reasonable efforts to provide useful and accurate website information.

However, information may occasionally contain typographical errors, outdated descriptions, technical errors, pricing errors, unavailable offerings, or other inaccuracies.

Material terms applicable to an existing paid engagement will be governed by the agreement in effect for that engagement rather than being retroactively changed solely because general website content was updated.

19. Availability of Services

We do not guarantee that every website, portal, software platform, course, digital service, or online system will be continuously available or error-free.

Maintenance, third-party outages, security events, updates, internet interruptions, technical failures, events beyond our reasonable control, or other circumstances may temporarily affect availability.

We may modify or discontinue services subject to any rights or obligations established under an existing client agreement or applicable law.

20. Privacy

Your submission and our handling of personal information are also governed by the Fresh Start Global Enterprise Privacy Policy and any additional privacy or confidentiality requirements that apply to a particular service.

21. Disclaimer of Warranties

To the fullest extent permitted by applicable law, websites, general informational materials, and services that do not contain a separate express written warranty are provided on an “as available” and “as is” basis.

Fresh Start does not make warranties that are not expressly stated in these Terms or an applicable written service agreement.

Nothing in these Terms excludes warranties, consumer rights, professional duties, or other protections that cannot lawfully be excluded.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Fresh Start Global Enterprise and its applicable affiliates, officers, directors, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the general website or services, including lost profits, lost business opportunities, or lost data, except where such limitation is prohibited by law.

For claims arising from a specific paid professional service, any additional limitation-of-liability provisions contained in the applicable engagement letter or service agreement will apply.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Fresh Start Global Enterprise and its applicable affiliates, officers, directors, employees, contractors, and representatives from third-party claims, losses, liabilities, and reasonable costs resulting from:

Your unlawful use of the website or services

Your material violation of these Terms

Your infringement of another person's intellectual property or legal rights

Content you submit in violation of applicable law or another person's rights

This provision does not require you to indemnify Fresh Start for conduct for which indemnification cannot lawfully be required.

24. Suspension or Termination

We may suspend or terminate access to a website, account, software system, membership, community, program, or other service when:

These Terms are materially violated

Payment obligations are not satisfied

Fraudulent or unlawful activity is suspected

Security is threatened

Unauthorized account sharing occurs

Intellectual property is misused

Continued access creates a reasonable risk to Fresh Start or others

Termination is otherwise permitted under the applicable service agreement

Termination does not automatically eliminate payment obligations or other responsibilities that arose before termination.

Terms that by their nature are intended to continue after termination—including intellectual property, payment obligations, confidentiality, limitations of liability, dispute provisions, and indemnification—will survive termination where applicable.

25. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except when applicable federal law or another law that cannot legally be waived controls.

Unless a separate written agreement provides otherwise or applicable law requires a different forum, disputes arising from these general Terms shall be brought in a court of competent jurisdiction serving DeKalb County, Georgia, and the parties consent to jurisdiction and venue there.

26. Separate Agreements

Certain Fresh Start services require separate engagement letters, service agreements, enrollment agreements, licensing agreements, payment agreements, or other contracts.

These website Terms do not replace those agreements.

If there is a conflict between these general Terms and a signed or specifically accepted agreement governing a particular service, the more specific agreement will control with respect to that service.

27. Severability

If any portion of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.

The remaining provisions will continue in effect.

28. No Waiver

If Fresh Start does not immediately enforce a provision of these Terms, that does not mean Fresh Start has waived the right to enforce that provision later.

A waiver of one provision or violation does not automatically constitute a waiver of another provision or future violation.

29. Entire Agreement

These Terms, together with the Privacy Policy and any policies, agreements, engagement letters, checkout terms, enrollment terms, or service-specific documents expressly incorporated into a transaction, constitute the applicable agreement regarding use of the website or service.

30. Changes to These Terms

We may update these Terms to reflect changes to our business, technology, services, or legal requirements.

The Last Updated date at the top of this page will identify the most recent revision.

Changes to general website Terms will apply prospectively as appropriate.

Where an existing agreement requires additional notice, consent, or a different amendment procedure, the requirements of that agreement will control.
